If you're researching Trademarkia before using them, congratulations. You're already smarter than I was. I wish I had done the same.

Pricing: classic bait-and-switch

They lure you in with a $99 price point, but read the fine print (which they won't explain upfront), and you'll quickly realize you're in for $299 + government fees—barely the tip of the iceberg. By the time my website name and tagline were finally submitted and approved, I was nearly $5,000 in the hole.

Why? Because what they don’t tell you is that trademarking is a multi-step, multi-class process—and they’ll nickel and dime you every step of the way. Oh, and watch out for their $99/month trademark monitoring fee—they automatically enroll you, and I only caught it after months of useless charges.

Customer service: nonexistent

If there were an award for worst customer service, Katie, my so-called attorney, would win it. She ignored emails, dodged calls, and dragged her feet for months. It took two months of constant follow-ups and escalating frustration before they finally submitted my Statement of Use (SOU) on the deadline day—after sitting on everything they needed for two whole months. Had I not emailed and called daily for the last week, they absolutely would have missed the deadline.

Their support staff? Foreign outsourced assistants who provide conflicting, often incorrect information—adding to the chaos rather than resolving it.

Bottom line: stay away

Save yourself the headache, stress, and money. Find a reputable local trademark attorney and pay a couple of grand to get it done correctly and without the nightmare.

My experience with Trademarkia was, hands down, the worst professional service I have ever encountered. Proceed at your own risk.

Just like the other bad reviews state, this is a scam. They take your money and then claim office actions or other nonsense filings are the cause of the price increase.

You would be far better off to consult an actual attorney and get proper advice for far less. Simple TM's turn into endless expenses and you also risk ruining your chance at the actual TM you applied for.

Again you are not even represented by an attorney. Utterly Pointless TM lookup service posing as a TM filing assistance.

A La Carte Word Trademark Filing Service - FVCproductions: $69

A La Carte Logo Trademark Filing Service: $199

Trademark Filing Government Fee in The United States x 2: $279

Total Cost? $818.

And now they want another $279 for each.

24 emails later (most of them that want me to just pay more) and I still don't have my logo or word trademarks registered.

Seriously though, if you want to register a trademark, hire an actual attorney and ideally pay a lot less than I did with real results.

Dear customer, sorry for your inconvenience. But we would like to remind you that trademark filing process is very complicated and goes through various processes.

Your's or attorney's job is not complete after the initial filing process. If your application receives an office action from the USPTO (which 80% of all applications do) then your assigned US licensed attorney would resolve it for a fee ranging from $279 - $649.

Even after doing so, your mark is not guaranteed to pass. I hope this helps.

Avoid at all costs! Biggest *** out there.

You pay intial fees and then when you think you are ready to have trademark filed, they hit you with all these extra fees.

Why not disclose all thesw fees prior and have them all paid upfront? Refuse to give refunds as well.

I ran into a similar issue and got the same runaround answers.

Dear customer, our fee structure is pretty clear and easy to understand on our website. Depending on your application and the package you choose, there is a base fee +the govt fees.

If your Trademark receives an office action, then there is an extra fee for that because an attorney has to take their time and work on the response.

No refund :(

I submitted my application and initial payment and then realized there were so many charges I had not foreseen. I asked for a refund less than 24 hours afterwards and they refused saying they had already started the process.

Horrible experience. Do not use or make sure you spend A LOT of time reading the small print first.

Lesson learnt. :(

It's false to say that you issue large refunds on a daily basis! After the fact, I read TONS of complaints about you NOT giving refunds and all of the hidden costs involved in the process which are not included in your video. I only wish I had done my research before I made the error of giving you my money!

Dear customer, Trademark filling process is a complex task, as there are millions of trademarks that already exist. Therefore, as soon as we get your application, our US licensed attorneys start working on it, and they need to be compensated for their time and hard work.

However, we do provide refunds on a large scale on a daily basis. Our refund policies vary from case to case.

Dont Use Trademarkia. Scam!!

Please, if you don't have money to waste, don't use Trademarkia to file for your trademark. They will continue charging you hidden fees until you are broke.

Don't expect a refund as well. I wish I made my research before losing my $400.00. I filed for my trademark a month ago, I was not informed about any hidden charges. I paid both trademarkia and government fees upfront.

After a month they said that I need to pay a certain amount of money for government fees.

I accepted that they charge me the amount they requested, but later that same day, they said that the amount they requested earlier is not correct, and they doubled the amount. Just be careful folks.

We were new business owners and so excited to find a place that would make the processing and trademark stuff easy on us. Little did we know we would be taken advantage of.

We paid the fees then started getting emails on how we can't be trademarked because another business(who had NOTHING to do with ours) had a similar name, then they told us we couldn't file because a company in brazil was selling similar services. We weren't applying for out side of the US, only in the US. They then told us we had to pay $649 to argue against some examiner in order to keep our trademark. And proceeded to tell us the chances were not good.

We asked for a refund and were denied.

So now we are out on hundreds of dollars. They are rude, incompetent and a rip off.

Yes, everything I'm reading here is true. All they do is try to up-sell you at every turn... and then take money from you with no clear reason for each batch of money they request.

This is a clear scam. See BBB.

Beware... do not use this company

These are not lawyers, and they know very little about the laws around Trademarks. They just plug you into their system and keep asking questions so they can up-sell you.

What else can I say... you'll also find, not one person that works there has a name you recognize as someone that is from this country. I think it's an off shore company that found a way to make themselves look legit. THEY ARE NOT

This has been the most unethical American experience to date and wish I had checked posts like this: http://everythingtrademarks.com/2013/11/20/trademarkia/ The process started out with several "attorneys" writing emails to me, pitching different classes and what not, pushing the delivery date a few more days for extra checks then giving the green light for the registration and then having another "attorney" invalidating everything the 3 before him said, also refusing a refund even if this is a question I asked from the get go: how fast can I get reimbursed if this doesn't work? all of them avoided the question until they felt they had the justification for legal advice hours to cover the bill and deny the refund to money they did not earn.

The company has dozens of scam articles, just Google it.

Stay away from it since it costs quite a bit to trust them. Most likely the comments posted with 4-5 star review are fake, bought on Mechanical Turk, self promoting mechanism to burry the truthful reviews.

I ordered trademark filing services with them. The next day they emailed back and wanted me to upgrade my plan to the GOLD VIP level.

Realizing my fees to the company had just begun, I decided to cancel the service after three business days. My refund has been denied with this company.

Fraudulent. We filled out an online application to trademark a name. It has been used in the past for a movie and related graphics. We wished to trademark the name for products representing the original and the sequel.

We asked for protection in two categories, clothing and paper goods since commerce in these categories has occurred. Trademarkia informed us that our application is not eligible for their services because words, as in a name, cannot be trademarked. As a result of this limitation we cannot apply to the government for protection.

Their position is they cannot provide us with application services but they billed us anyway. Fraudulent practices.

TRADEMARKIA IS A SCAM!!

This company takes your private information and posts it all over the web. Although trademark information is public, the owner Raj Abhyanker is a complete opportunist and then tries to sell your company name and domain names all over the world!

It is immoral and should be illegal. He is a special kind of rotten. I and many others are trying to get the legislation fixed so that this practice will become illegal. Even after speaking with the California State Barr of Attorneys they did say that we have a legitimate reason to file a case and to file a complain against this individual and his company.

This is not how honorable attorneys operate! BEWARE!

Go through a separate trademark attorney that you trust with your ideas and name. STAY AWAY!

Second when I paid the lawyers fees and government fees they advertised on the internet, Trademarkia had the balls to demand more money to continue the registration process. I was extremely pissed. I don't like playing games.

I agree with most of your complaint. However once a trademark is applied for it is public information.

Trademarkia is a SCAM. They do virtually nothing except copy and paste from the class description and don't provide any real legal advice or help in the application. They don't cross reference properly for prior art, and they refuse to respond to email wuestions.

I now have a real attorney who will need to refile because the original is too screwed up and has a missing class. I too will be making local and federal complaints unless they reply to my last email, which gives them a choice to make it right or go to court themelves.

Hi Mitchhc Trademarkia itself does not file trademarks and has no attorneys on staff. Your filing is being done by a Law Firm.

I understand that an attorney at the firm who filed your trademark has been in touch with you. I expect that the attorney will go over your options and any strategy to move forward with the trademark process.

I agree with all of the above comments. They advertise one price plus the government fees and then in order to finish the process you are billed again and again. They practice very deceitful advertising:

"Trademark Registration – Best Prices, Fast & Easy Process", Trademarks for just (xxx.00 USD) + government fee." - no where in their advertising do they mention that there are additional fees on top in order to complete - no doubt it is well hidden somewhere in the bowels of their website where these bottom-feeding scam artists dwell. It is certainly not in their in-your-face pricing claims.

Their website looks very legitimate and they look lilke a reputable compamy to deal with. They are not.

And their "100% Customer Satisfaction Guarantee"? Not sure what it actually guarantees. I can guarantee that if you deal with them you will end up with a headache and a *** of a lot less money in your wallet than you anticpated.

I ended up paying three times the original quote AND still don't have my trademark confirmed. Buyer beware. If it sounds too good to be true, it is.

I'm not certain if it is a complaint and/or court filing you're interested in pursuing. Consumer complaints AND civil actions can BOTH be filed in the USA.

For complaints, you can file with the BBB (Better Business Bureau) or other consumer advocate organizations. Best to Google "consumer advocate organizations" in you're area. You should look by county, zip code or state. I apologize for not having ready links.

For civil complaint actions the requirement is simply if the business or contract originated in your county within the USA. I don't believe Trademarkia (tm) can skirt the responsibility. If you do not wish to file in Superior Court, depending on your county, Small Claims generally award up to $7500 in toto. You will generally be awarded direct damages up to that amount, thus punitive damages, etc. will not apply.

You may (should Trademarkia (tm) has a history of illegal practices and have significant assets) find an attorney to take your case on contingency. Generally the rate is 30/70 if settled out of court or 40/60 if it goes to trial. These percentages usually do not include costs (filing, costs related to discovery, copies, court reporter, etc).

If you do choose to go this route, make sure you do your due diligence and consult with more than one attorney. Best of luck with whatever avenue you choose.
